Convertly is provided by BINARY BRAIN TECHNOLOGIES SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, which owns and operates Convertly and is your contractual counterparty ("we", "us"). Company details:

By creating an account or using Convertly, you agree to these Terms of Service, our Privacy Policy, and our Data Processing Agreement (DPA). If you do not agree to these terms, please do not use our service.

Convertly provides a platform for creating and managing interactive quizzes for lead generation. We offer both free and paid subscription plans with different features and usage limits.

You must create an account to use certain features of our service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.

You agree not to use Convertly to: collect special categories of personal data (health, racial/ethnic origin, political opinions, religious beliefs, sexual orientation) without appropriate legal basis and explicit consent; create quizzes that discriminate against individuals based on protected characteristics; collect data from children under 18 without verifiable parental consent; send spam, phishing content, or misleading communications; violate any applicable laws or regulations in your jurisdiction; infringe on the intellectual property rights of others; attempt to reverse-engineer, decompile, or compromise the security of the Service. We reserve the right to suspend or terminate accounts that violate this policy.

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders: you buy a Convertly subscription from Paddle, and Paddle's Buyer Terms apply to that purchase. Paddle handles billing, invoices, taxes (including VAT), refunds and payment cancellations, and answers payment-related questions. Paid plans are billed in advance, monthly or yearly, and renew automatically until you cancel. You can cancel at any time in your account settings; the cancellation takes effect at the end of the current billing period and you keep the paid features until then. Refunds are described in our Refund Policy. We may change our prices with at least 30 days' notice; a change applies from your next billing period.

You retain ownership of any content you create using our service. By using Convertly, you grant us a license to use, store, and display your content as necessary to provide the service. You are the data controller for any lead data collected through your quizzes. Convertly acts as a data processor on your behalf, governed by our Data Processing Agreement (DPA). You are responsible for ensuring that your quizzes comply with applicable data protection laws, including obtaining appropriate consent from quiz respondents.

Our platform, including all software, designs, and trademarks, remains our property. You may not copy, modify, distribute, or create derivative works based on our platform without our prior written consent.

We may suspend or terminate your account for violations of these terms. You can delete your account at any time in your account settings: the deletion is immediate and permanent, deletes your quizzes and leads, and cancels an active subscription (see our Privacy Policy). When your account ends, your right to use the service ends.

Our service is provided 'as is' without warranties of any kind. We do not guarantee that the service will be uninterrupted or error-free. We are not responsible for any content created by users or for any damages resulting from use of our service.

To the maximum extent permitted by law, Convertly shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service.

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Poland. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Poland. If you are a consumer within the EU, you also retain any mandatory consumer protections provided by the laws of your country of residence.

We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through the service. Your continued use of the service after such modifications constitutes acceptance of the updated terms.
