Please read these Terms of Service carefully before using Convertly. By accessing or using our service, you agree to be bound by these terms.
1. Service Provider / Legal Entity
Convertly is provided by BINARY BRAIN TECHNOLOGIES SP. Z O.O. (NIP: 7133142056, REGON: 54334690400000, KRS: 0001207918), based in Poland, with website https://binarybrain.dev. This entity owns and operates Convertly and is your contractual counterparty.
2. Acceptance of Terms
By creating an account or using Convertly, you agree to these Terms of Service, our Privacy Policy, and our Data Processing Agreement (DPA). If you do not agree to these terms, please do not use our service.
3. Description of Service
Convertly provides a platform for creating and managing interactive quizzes for lead generation. We offer both free and paid subscription plans with different features and usage limits.
4. Account Registration
You must create an account to use certain features of our service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.
5. Acceptable Use Policy
You agree not to use Convertly to: collect special categories of personal data (health, racial/ethnic origin, political opinions, religious beliefs, sexual orientation) without appropriate legal basis and explicit consent; create quizzes that discriminate against individuals based on protected characteristics; collect data from children under 18 without verifiable parental consent; send spam, phishing content, or misleading communications; violate any applicable laws or regulations in your jurisdiction; infringe on the intellectual property rights of others; attempt to reverse-engineer, decompile, or compromise the security of the Service. We reserve the right to suspend or terminate accounts that violate this policy.
6. Payment Terms
Paid subscriptions are billed in advance on a monthly or annual basis through Paddle (our Merchant of Record). You can cancel your subscription at any time. All paid plans include a 14-day money-back guarantee from the date of initial purchase. Contact us at support@convertly.buzz within 14 days for a full refund. We reserve the right to change our pricing with 30 days notice. Paddle's terms of service apply to payment processing.
7. Your Content and Lead Data
You retain ownership of any content you create using our service. By using Convertly, you grant us a license to use, store, and display your content as necessary to provide the service. You are the data controller for any lead data collected through your quizzes. Convertly acts as a data processor on your behalf, governed by our Data Processing Agreement (DPA). You are responsible for ensuring that your quizzes comply with applicable data protection laws, including obtaining appropriate consent from quiz respondents.
8. Intellectual Property
Our platform, including all software, designs, and trademarks, remains our property. You may not copy, modify, distribute, or create derivative works based on our platform without our prior written consent.
9. Termination
We may terminate or suspend your account at any time for violations of these terms. You may cancel your account at any time through your account settings. Upon termination, your right to use the service will immediately cease. We will retain your data for 30 days after termination, after which it will be permanently deleted.
10. Disclaimers and Warranty
Our service is provided 'as is' without warranties of any kind. We do not guarantee that the service will be uninterrupted or error-free. We are not responsible for any content created by users or for any damages resulting from use of our service.
11. Limitation of Liability
To the maximum extent permitted by law, Convertly shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the service.
12. Governing Law and Jurisdiction
These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Poland. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts in Poland. If you are a consumer within the EU, you also retain any mandatory consumer protections provided by the laws of your country of residence.
13. Changes to Terms
We reserve the right to modify these terms at any time. We will notify users of any material changes via email or through the service. Your continued use of the service after such modifications constitutes acceptance of the updated terms.
